In general, time spent in job-related training is considered work time and must be compensated. However, not all training sessions, classes, or programs qualify for paid time. Here are the four criteria that must be met for training to be unpaid:

Outside Normal Work Hours: The training must take place outside of the employee’s regular work hours.

Voluntary Attendance: The training should be entirely voluntary, with no company-initiated consequences for non-attendance.

Not Job-Specific: The training should not be directly related to the employee’s job. While it may be tangentially related, like most continuing education, it shouldn’t be specific to their day-to-day tasks or aimed at training them for new job duties.

No Work Performed: The employee must not perform any work for the employer during the training, such as reading or replying to emails.

Examples:

If a software developer enrolls in an evening college class to learn a new coding language that isn’t used at their workplace, this training does not need to be paid.

Conversely, if a graphic designer attends a workshop to learn a new software tool that will be used in upcoming projects, this training time should be compensated.

Key Takeaway: Understanding these criteria can help employers and employees navigate the complexities of training time compensation. By meeting all four criteria, employers can determine when training time does not need to be paid, ensuring compliance with labor laws and fair treatment of employees.

For more information on employee training compensation and compliance, contact Southern Payroll & Bookkeeping today!

The Importance of Pay Statement Compliance for Employers in 2024

In today’s complex payroll landscape, simply withholding federal and state taxes, health insurance premiums, and retirement fund contributions from employees’ gross pay is not enough. Employers must “show their work” by clearly displaying every dollar paid and withheld. Failing to do so could result in costly penalties and potential class action lawsuits.

Understanding Pay Statement Compliance

Maintaining compliance with pay statement disclosure requirements is crucial for employers. Compliance risks include government audits, litigation, penalties, and reputational damage. If employees perceive discrepancies between their expected compensation and reported wage statements, conflicts can arise.

For instance, in California, non-compliant pay statements can lead to penalties of $50 per employee for the first violation, up to $4,000 per employee plus costs and attorney’s fees. For large companies, these penalties can be substantial.

Essential Components of Pay Statements

Pay statements play a critical role in wage payment compliance. They simplify payroll complexities, provide transparency, and help resolve disputes. While specific requirements vary by state, typical pay statements should include:

Contact and Date Information: Employer’s name, address, phone number, pay period dates, and employee details. Some states may require an employee identification number.

Pay Rates and Hours: Details on regular, overtime, and double-time rates, along with corresponding hours worked.

Gross Earnings: Total earnings before any deductions.

Employee Taxes: Deductions for federal income tax, FICA taxes (Medicare and Social Security), and state/local taxes if applicable.

Benefit Deductions: Employee contributions to employer-sponsored benefit programs.

Employer Taxes and Contributions: Employer responsibilities for taxes, including federal and state unemployment taxes, FICA taxes, and potential benefits contributions.

Garnishments: Withholdings for court-ordered reasons like child support, defaulted loans, or tax levies.

Paid Time Off (PTO): Accrued hours, taken hours, and balance for vacation, sick, or personal days.

Net Pay: The amount paid to an employee after all deductions.

State-Specific Requirements: Any additional fields required by specific state or jurisdiction regulations.

Key Takeaways for Employers

To ensure compliance and avoid potential risks, employers should consider the following:

Include All Required Information: Ensure wage statements contain all relevant details as per state regulations.

Evaluate Payroll Systems: Verify that payroll systems have the necessary fields to meet compliance requirements. Consult with payroll system providers to assess risk exposure.

Understand Penalties: Be aware that non-compliance can lead to significant fines and penalties.

Partner with Experts: Consider partnering with Gusto to ensure accurate and timely payment of employees and taxes.

Navigating pay statement compliance doesn’t have to be daunting. By staying informed and working with knowledgeable providers like Gusto, employers can ensure compliance, maintain positive employer-employee relationships, and avoid costly penalties.

Paying employees correctly will help protect you and your company from violating the Department of Labor's "wage & hour" rules.

The post How Important Is Paying Employees “Correctly?” appeared first on Southern Payroll & Bookkeeping.

In all the talk the last few years about raising the minimum wage to $15/hour, you might start off thinking that I was referring to that when I say you have to pay employees “correctly”…you would be wrong. I’m referring to the legal obligations your company has in regard to payments. If you ignore the laws, there are penalties…which a couple Tennessee companies found out recently. Let’s start with an example up near Knoxville…

Resolution: On April 6, 2023, Judge Clifton L. Corker of the U.S. District Court for the Eastern District of Tennessee at Knoxville issued a consent order and permanent injunction in a case that the U.S. Department of Labor filed against Pigeon Forge Hospitality, LLC and Nimesh Patel, operator of a Comfort Inn in Pigeon Forge, Tennessee. The order requires the hotel operator to pay $27,296 in back wages and an equal amount in liquidated damages to six workers.

An investigation by the department’s Wage and Hour Division found the employer willfully failed to pay workers at least the federal minimum wage, as well as overtime rates of at least time-and-one-half for hours over 40 in a workweek. Investigators also found that Pigeon Forge Hospitality engaged in oppressive child labor by employing two minors under the age of 12.

https://www.dol.gov/newsroom/releases/SOL/SOL20230410

Even more recently, the Department of Labor recovered $270,000 in back wages after an investigation into Cilantro Five Points in East Nashville. They were found to have failed to pay overtime, force shared tips with dishwashers, and even neglected to pay minimum wage for all hours in a work week. (The Tennessean)

Do you want your employees to hate you? Not paying them correctly is one of the best ways to achieve that! But here’s the thing…it may end up as the least of your worries as other problems start to mount up.

Call In the DOL

One of the worst things that will happen if employees believe you haven’t paid them is a Department of Labor investigation into “wage and hour violations.” The laws the DOL enforces encompass minimum wage requirements, overtime provisions, and regulations governing other aspects of employee compensation. Take the time to read over the two cases above and you’ll find that the DOL doesn’t leave stones unturned once they start an investigation…what started out in Pigeon Force as a dispute over wages ended up as a child labor case, as well.

If you are found to have underpaid employees, your company will be forced to pay the affected individuals the wages you owe them…simply put, you’re not going to get away without paying them, so maybe just pay them in the first place! Especially because if you’re found to be in violation of the law, you are likely going to be on the hook for penalties imposed by the DOL or courts.

Keep It Classy

If you have a larger company and have made a practice of shoddy payment practices, they may end up joining forces and filing a class-action lawsuit against you. This may significantly increase the potential for payment of back wages…and penalties…not to mention all the legal costs you’re going to incur to fight a class-action.

You don’t want this to happen for more than just the monetary issue, though…class-action suits tend to attract a lot of negative attention for the defendant. That’s something no company wants as it can cause permanent harm to your reputation, making it incredibly difficult to recruit good employees in the future.

And reputational damage isn’t just limited to class-action-sized cases. While those may garner news coverage and get out in front of large numbers of people, these days reputational damage can be done just as effectively through social media with the right people making noise.

It Often Goes Deeper

If the Department of Labor or other enforcement agency gets called in with a complaint about incorrect wage payments, they have the authority to conduct an audit or call for a deeper investigation into your payroll practices. Non-compliance with the law in one case will often cause everything you do to be scrutinized in much more detail.

If the case is extreme, the violations of the law can result in criminal charges. This is normally reserved for outright theft of wages or intentional fraud, but penalties can include high fines or imprisonment.

What You Need To Do

First and foremost, make sure you are familiar with the relevant laws governing minimum wage, overtime, record-keeping, and other employee compensation details in all the jurisdictions you fall under…municipal, county, state, and federal.

Next, make sure your payroll systems are current and up-to-date. Investing in a reliable, accurate payroll system will help you calculate wages correct, and ensure that your employees can see everything should they have any questions. You minimize the risk of errors and they get transparency. We at Southern Payroll & Bookkeeping recommend Gusto, an easy-to-use, but scalable, payroll solution. Call 423-207-2497 if you have questions or want to get started with Gusto.

Make sure you maintain good and detailed records of employee wages, hours worked, and other relevant payroll information. If you get audited and you can produce accurate, detailed records, you will go a long way toward dismissing any suspicion of wrong-doing on your part.

You should probably consult with a labor attorney. No one is going to know the laws pertaining to your business and in your jurisdictions like a local labor attorney. Ask them for help in interpreting complex regulations and reviewing your company’s policies.

And you should make sure to regularly review those policies with your employees, making sure they understand their legal obligations as well as yours…and update those policies when you need to.

Clear communication with your employees, accurate and detailed record-keeping, and transparency all work together to keep your company out of the crosshairs of law enforcement when it comes to wage and hour disputes…keeping your company moving forward and producing profit.

Quick answer: A pay stub breaks your paycheck into what you earned, what was taken out and what you keep. Check these lines every payday:

Pay period and pay date: the dates worked and the date you were paid.

Hours and pay rate: regular and overtime hours, plus your hourly rate or salary.

Gross pay: total earnings before anything is taken out.

Pre-tax deductions: items like 401(k) contributions and health insurance premiums, which lower your taxable pay.

Taxes withheld: federal income tax, Social Security (6.2%), Medicare (1.45%) and state income tax where it applies. Tennessee doesn’t tax wages.

Post-tax deductions: items like Roth 401(k) contributions, garnishments or union dues.

Net pay: your take-home amount.

Year-to-date (YTD) totals: running totals for the year, which should match your W-2 in January.

I know that we all love payday, but how often do you actually take an in-depth look at your pay stub? It is easy for your eyes to immediately go to the bold number at the bottom of the page, but there are so many other factors to look into when reading your pay stub. Doing so can give you some insight on where exactly your deductions are going.

It can be hard to understand what is what when there are so many moving pieces. In this weeks Tuesday Tip, we will be going over a typical paycheck so that you know exactly where your money is going.

Employee Information

The first thing that you will see on your paystub is employee and employer information. You will also see the pay period so that you know what time period you are receiving earnings for. Gusto, the payroll platform that we partner with at SPB, also allows employees to split their pay into separate bank accounts, making it easy to put a fraction of your paycheck into savings or investments. You will also be able to see exactly how much is deposited into each account from that pay period in this section of your pay stub.

Employee Earnings

On this part of the paystub, you will see your hourly rate and hours worked, or your salary. If you are a salaried employee, your hours are defaulted to 40 per week. For hourly employees, this part of the pay stub will also show overtime. You will also see any bonuses or commissions for the pay period on this part of the stub. It is very important to note that this will reflect your gross earnings, which is what you make before deductions, taxes, and contributions.

Employee Taxes Withheld

This includes taxes that are taken out of your gross earnings and will be on your W-2 when you receive it for tax filing purposes. Withholding tax means that you pay-as-you-go. The government withholds three types of taxes from your earnings.

Federal Income Tax: Your federal income tax can be calculated through your W-4 form. There are 3 things that determine how much you withhold – marital status, number of allowances, and compensation.

Social Security: This tax pays for federal retirement and benefits. It is calculated as 6.2% of your gross earnings.

Medicare: This tax provides federal health insurance for Americans 65 and older. It is calculated as 1.45% of your gross earnings if you make under $200k annually, and 2.35% if you make more than 200k.

Employer Taxes

The next section you will see includes the taxes that are taken from your employer. These do not affect your net earnings. The important take away from this section is that these amounts are the employers burden, not the employee. Because the employer pays taxes on behalf of the employee, the cost of an employee is actually higher than their gross earnings.

Employee Deductions

In this section, you will see your retirement, healthcare, and any other benefits reductions. This can include medical, dental, vision, or any other type of insurance plan your company offers.

Employer Contributions

This includes any of the contributions that your employer pays towards your retirement, healthcare, or any other benefits.

Summary

The summary section shows your gross earnings, your pre-tax deductions, taxes, post-tax deductions, reimbursements, and your total check amount (your net earnings). It shows you clearly where your earnings are going.

Reading your pay stub may seem confusing at first, but it does not have to be. We hope that this short blog post helps you read your pay stubs and understand fully where your hard-earned money is going. Keep up the good work!

Hiring employees to work at your fairly-new business can seem intimidating. You might be asking yourself, “Where do I even begin?”. Well, here at SPB, we care about partnering with small businesses and giving them the tools that they need to not only survive, but thrive. We share the same passion that you do– to set yourself, your team, and your business up for success. So this week, we are sharing step-by-step instructions for you on how to prepare yourself for your first couple of new-hires!

How to get your business ready to hire:

Take a step back and think about if you need another employee. We know that is easy to feel overwhelmed with the responsibilities of owning your own business. Be very specific about the work that you need done by this employee and evaluate the time that it will take them. Make sure that you do the math on how many hours a week it takes to do the type of work that you are thinking about hiring for. If it doesn’t add up to a full time schedule, it will probably not be worth it to hire a full-time employee. Hiring someone on full-time is an ongoing cost for your business. Remember to think very carefully about whether you should hire an employee or a contractor.

Ask yourself if your business is actually ready to hire someone. Can you afford the costs of a hire? You need to remember that it will cost you more than just salary to pay them. Make sure to do a cost-benefits for your time. Is the role you are hiring for defined? When it comes to hiring someone, you need to make sure that your company values and policies are established and that you plan to hire according to them.

If you answered “yes” to the last two points and have decided that you are going for it, then it is time to get your EIN. You need to get a few legal things in order first, the first one being an Employer Identification Number. You can find where to apply for one of those here. An EIN is the number that the IRS gives you to identify your business. Think of it as this: a social security number for your company, except you use it on all documents and forms when it comes to paying your employees.

Once you’ve got your EIN, it is time to prepare for all of your tax requirements. They differ from state to state, so it is important to seek some professional advice in your area. Some rules to keep in mind are..

You will need to file form W-2 to report wages for each employee that you have.

You must deposit and report unemployment taxes.

Employers have to withhold taxes from your employees according to the IRS withholding tables.

You must deposit your withholdings.

You also need to withhold part of Social Security and Medicare taxes from each employees’ wages and pay a matching amount yourself.

Employers need to withhold 0.9% Additional Medicare Tax on wages if the employee exceeds the threshold amount. This is where the costs of hiring really seem to add up. Your state can have certain obligations, too. That is why it is so important to contact your specific state’s Department of Labor to find out exactly what those requirements are.

There are a few things to do to be positive that you’re good with the law when you hire someone. When you do hire, each employee will have to fill out a W-4 and an I-9 form. A W-4 will provide information on how much income tax to withhold from their checks. An I-9 will assure you that they are authorized to work in the United States.

Decide how to handle your payroll. It is never as simple as writing a check. You need to make sure that you have a way for your employees to clock in and out, that you pay them on time, and give them a good experience, too. Choosing to outsource your payroll to a provider like SPB can help with that. At SPB, we train both you and your employees in Gusto, our payroll software of choice. We even run your first payroll with you! We choose to partner with Gusto because they make it easy for your employees to see their paystubs at-hand, fill out the required forms (W-4,I-9), track time, and so much more.

After you follow these 6 steps, you’re ready to hire! Now that you have finished all of the prep work, it is time to look for your first employee! Create a job description that attracts candidates and clearly lays out exactly what you are looking to hire for. We hope that your ideal candidate comes soon!

Hiring new employees can seem like a hassle, we get it. Lucky for you– when you are on Gusto’s Plus or Premium plan, one-step provisioning helps to migrate your employees information straight from their signed offer letter to other apps that your company uses.

We use Gusto’s one-step provisioning to assign company email addresses, create Google accounts, and so much more. It makes creating company profiles easy for us!

When provisioning apps are set up within your Gusto account, you have the option to automatically create and remove third-party app accounts for your team directly from Gusto. You can..

Create, view, or remove your team member’s app accounts directly from Gusto.

Set up a new hire app account quickly from the onboarding checklist.

If one of your employee’s leaves the company, you can disable their access securely at the same time you dismiss them.

How to add a new app for your company:

Sign in to your Gusto admin account.

Go to your App directory.

Click Provisioning apps.

Select the software you wish to connect.

Click Connect (if your company already has an account with the software). Click Get [App Name] (if your company does not have an account yet).

Enter admin credentials for the app.

Enjoy how incredibly easy that was!

There are 63 apps that Gusto integrates with, but here are some popular examples:

Owning a business can be hard.. we all have those employees that make every hard day just a little bit easier! Put on your Santa hat– Saint Nick won’t be the only one delivering presents this year!

Are you planning to spread some holiday cheer among your employees by giving a Christmas bonus? Running a bonus in Gusto is super easy. Here are some key things to know to make sure you stay compliant and make your employees happy!

Woo-hoo! There is nothing like that “Holiday Bonus” feeling!

First, go to Payroll on your Admin menu and select Run Payroll. Next, scroll down to “Other payroll options” and select Bonus Payroll. You will enter a work period, which is the timeframe that the employee worked to earn this payment. Next, select the check date. This is the date that you want your employees to be paid this bonus. Then, you will want to block all deductions and contributions. Important: Gusto is unable to turn off 401(k) deductions and contributions due to the requirements of most plans. Next, you will need to review the tax withholding rates. You will need to select Edit rates under the Tax withholding rates section. If the bonuses are under $10k, you will choose use rate for regular wages. If it’s over $10k, you will select use supplemental rate, as this will tax them at the appropriate tax bracket. Next to the employee, click Enter Payment and choose either Gross Earnings or Net Earnings. For example, if you want “Joe” to take home $200, you will choose the net earnings so Gusto will gross up the amount to account for taxes. If you want Joe to receive $200 with taxes applied, you will enter in gross earnings. Be sure that the payment method is correct as a check or direct deposit. You’re almost done! Click Save & Continue to review your bonus payroll. Important: If your employee has an active garnishment, you may need to check with the garnishment authority to see if there are specific requirements for garnishing the bonus payment. If everything looks good, click Submit Payroll. This will sure put a smile on your employees faces!

If you have any questions about Gusto, or any other payroll-related matters, remember… we are always only a phone call away and our payroll team will be happy to help!

Have a great holiday season!

December snuck up on us and it’s the end of the year! Have your employees double-checked that all their payroll and tax information is correct for their W2s in January? Has your human resources team checked to be sure that all the employer-reported information is correct too?

Many, if not most, that file their income tax reports will be due for a refund from the IRS and it is very important that both employee and employer information are correct in the employee’s Gusto payroll account to help them get the correct information on their W-2 for filing on time. This is the information that you will want to double check:

1 – Is the employee’s full, legal name entered correctly in Gusto? W2’s cannot have nicknames.

2 – Is their mailing address correct? When employers or Gusto mail these out, they can only go by what is in Gusto. If an employee has moved during the year and they have not updated their home address in Gusto, the W2 will be mailed to an incorrect address and cause delays. So be proactive – have your employees verify their address information now to avoid delays later!

3 – Are all wages are accounted for? Some employers occasionally give their employees a manual check for bonuses or other expenses. Be sure that anything paid outside of normal payroll checks is documented in Gusto before the end of the year to ensure that all taxable wages are reported correctly.

4 – Is the work location correct for all employees? In previous years, this was simply the office address. More and more, though, and especially in this post-pandemic era, many employees are working from home. If they live in a state that taxes income, this is an important distinction, especially if the employer is in one state and the employee lives in another.

5 – Are the FEIN and state account numbers noted correctly? We are all human and it is possible to enter a digit wrongly when typing. Wrong information can cause costly delays though so double-check to be sure that this information is right.

The pen and notebook on the tax form W-2 Wage and Tax Statement. The time to pay taxes

Checking this information pro-actively helps you, as the employer, to report necessary information to the IRS in a timely fashion. It also shows employees that you are looking out for their interests. Win-win!

For more helpful information about preparing W2s and other tax topics, visit the IRS here. And, of course, if you have any questions about verifying information in Gusto, or any other payroll-related matters, remember… we are always only a phone call away and our payroll team will be happy to help!

Most likely, your company offers paid holidays as one of its perks. Many of your employees may also schedule time off during this time of year because of the Thanksgiving and Christmas holidays that are right around the corner. For those employees, paid time off (PTO) was likely approved weeks or even months in advance. However, this time of year finds many families dealing with the flu and various respiratory-related illnesses, never mind that Covid is still an ongoing annoyance. Time off may be necessary for those employees, whether for themselves or to take time off to care for loved ones.

For all those reasons, it is beneficial to have your PTO policy available. With the Gusto software platform, it is easy to set that up so that those who need it can take the time off when it is needed most.

For holiday pay, your Administrator will log in to Gusto and select “Time Tools” on the left-hand menu. Next, they will click “Time Off”, then select the Holiday Pay box in the middle of their screen and choose the holidays that the company offers to pay employees for the year.

When employees need to request time off though, whether for vacation time or illness, the process is just as easy. They will log into the Gusto Wallet app on their phones and tap “Time Off” on the main screen, then tap on “Request Time Off”. They will be prompted to give a type of leave requested, the date(s) needed, and how many hours needed for the date(s) provided. Employees can also leave a note to say, for example, that their child is sick or has a doctor appointment. Once submitted, their request can be approved or denied just as easily by the company Administrator.

Regardless of why the PTO is being used, the process of requesting, approving, and recording it for payroll is super easy and quick. Of course, if you ever have questions or need our help maintaining your company’s payroll process, we are only a phone call away!
